Public Liability

Public liability refers to the legal responsibility of individuals or organisations to ensure the safety of individuals in public spaces or on their premises. Public liability cases arise when an individual suffers an injury or harm in public spaces, such as parks, shopping centres, restaurants, or on business or private premises.

When an individual sustains an injury or experiences harm due to negligence or unsafe conditions in public areas or premises, a medico legal specialist can play a crucial role in assessing, documenting, and providing independent medical opinions on the medical aspects of the case. Their expertise helps establish the link between the injury and the negligence or unsafe conditions, providing essential evidence for legal proceedings or compensation claims.

Our role in Public Liability claims

Medico legal assessments in public liability cases involve reviewing medical records, conducting medical examinations, and evaluating the injuries sustained by the individual. These assessments aim to determine the cause of the injuries and establish the connection between the harm and the negligence or unsafe conditions in the public space or premises.

Independent medical legal specialists provide objective evaluations and expert medical opinions on the medical aspects of the case. They assess the causation of the injuries, considering factors such as hazardous conditions, inadequate maintenance, lack of warnings or signage, or other elements contributing to the harm suffered by the individual. Their expertise helps establish the link between the injuries and the public liability, demonstrating that the harm was a result of negligence or unsafe conditions.

In legal proceedings related to public liability, our medico legal reports and expert testimony serve as crucial evidence. They provide a detailed analysis of the medical aspects, explaining the link between the injuries and the negligence or unsafe conditions, thereby substantiating the individual’s claims for compensation or damages.

Our medico legal specialist will play a significant role in establishing the liability of the responsible party in public liability cases through the comprehensive evaluation, documentation, and expert analysis of the medical aspects of the case.

360 Medico Legal receives instructions from solicitors, insurers and case managers together with medical documents. The referrer is provided with a list of potential independent medical specialists. Often the enquiry needs a particular specialisation or field of practice, and 360 Medico Legal can assist with this.
